Refund Policy

Effective date: 5 September 2025

Thank you for choosing Ektasi Technology (“Ektasi”, “we”, “us”). Because our work is digital, customized, and labor-intensive, refunds are generally not available. This policy explains when refunds or service credits may be considered and how to request one. This policy applies in addition to our Terms of Service and any applicable Statement of Work (“SOW”).

1) Scope

  • Digital services: product strategy, design/UX, web/mobile/software development, integrations, DevOps/cloud, security/compliance, data/analytics, AI/ML, experimentation, managed services.
  • Ektasi Labs modules: bulk email/SMS/WhatsApp, social automation, ERP components.
  • Digital goods: downloadable files, code packages, templates, documentation, and other intangible items delivered electronically.

2) General rule — non-refundable

All fees are non-refundable once work has started, access has been provisioned, code has been delivered, or digital goods have been downloaded/accessed. This includes discovery, configuration, customization, integrations, and one-off consulting, as well as retainers and prepayments already applied to work.

3) No returns on downloads

Due to the nature of digital goods, downloaded or accessed files cannot be returned or exchanged. Please review product details, compatibility notes, and any demos before purchasing.

4) Limited exceptions (defects/outages we control)

We may offer a remedy if our platform or deliverable is materially non-functional due to an Ektasi-controlled code defect or outage. “Material” means the core promised functionality cannot be used and there is no reasonable workaround.

Remedy order (at our discretion):

  1. Fix or replacement within a reasonable time; or
  2. Service credit applied to future invoices (default for subscriptions/managed services); or
  3. Pro-rated refund for the affected period or component only if a fix is not feasible within a reasonable timeframe.

Exclusions: Issues caused by customer environments, misconfiguration outside our control, third-party outages (cloud/ISP/payment/identity/ad platforms), force majeure, unsupported use, or changes made by you or third parties.

5) Subscriptions & managed services

  • Cancellation: You may cancel renewals at any time; cancellation takes effect at the end of the current billing term. No refunds for unused time in the current term unless Section 4 applies.
  • Service levels: Any service credits for availability/incident targets (if agreed in an SLA) are the exclusive remedy and are not redeemable for cash.

6) Retainers, deposits & milestones

  • Non-refundable once allocated to discovery, planning, or delivery work.
  • If work has not begun, we may, at our discretion, apply deposits as a credit to future services for up to 6 months.

7) Third-party fees

Cloud, domain, SSL, app store, marketplace, paid plugins/themes, ad platforms, SMS/WhatsApp gateways, payment providers, and similar third-party charges are non-refundable. Any refunds from such providers are subject to their policies.

8) How to request a fix/credit/refund

Email info@ektasi.io with the subject “Refund Request” and include:

  • Order/SOW number, invoice number, and dates
  • Clear description of the issue and why it is material
  • Screenshots, logs, error messages, URLs, and steps to reproduce
  • Your environment details (browser/app version, OS, network, etc.)

We will acknowledge within 2 business days and investigate. If eligible under Section 4, we will propose a fix/credit/refund within a reasonable period based on severity and complexity.

9) Chargebacks

Please contact us first to resolve billing issues. Unfounded chargebacks may result in suspension of services and you may be responsible for chargeback fees. We will provide documentation to your bank/payment provider as needed.

10) Compliance with mandatory rights

Nothing in this policy limits rights you cannot waive by law. In some jurisdictions (e.g., consumer laws in the EEA/UK), digital content may include a right to withdraw within 14 days unless you expressly consent to immediate performance and acknowledge losing that right upon download/access. Our services are primarily provided to businesses (B2B); if you are a consumer and mandatory rights apply, we will honor them.

11) Currency, taxes & fees

Refunds (if granted) are limited to amounts paid to Ektasi in the original currency, excluding bank charges, exchange losses, taxes, and third-party fees. Processing times depend on your bank or payment provider.

12) Updates to this policy

We may update this policy to reflect changes in services or law. We will post the updated version with a new effective date.
